1. Acceptance of Terms
TuLugar is a real estate platform based in Asunción, Paraguay. By accessing or using TuLugar (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
2. Platform Role
TuLugar is an online marketplace that connects property buyers, sellers, tenants, and landlords. TuLugar is NOT a real estate agent, broker, or party to any transaction conducted through the Platform. TuLugar owes no fiduciary duty to any user. All transactions are solely between users.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate and complete information when creating an account. You must be at least 18 years old to use the Platform. You are responsible for all activity that occurs under your account.
4. User Content
You retain ownership of content you post on the Platform. By posting content, you grant TuLugar a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with the Platform. You warrant that your content is lawful, accurate, and does not infringe on any third party's rights. TuLugar reserves the right to remove any content at any time, without notice.
5. Listing Accuracy
TuLugar does NOT verify listings, property ownership, legal titles, property conditions, or user identities. All listing information is provided by users and may contain errors or inaccuracies. Users must independently verify all property information, legal status, and conduct their own due diligence before entering into any transaction.
6. Messaging
Users are solely responsible for the content of their messages. TuLugar is not liable for any message content exchanged between users. TuLugar may monitor messages to prevent fraud and enforce these Terms.
7. Paid Subscriptions
Certain features require a paid subscription. Payments are processed by Stripe. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel your subscription at any time; access continues until the end of the current billing period. Refunds are not provided for partial billing periods unless required by applicable law.
8. Prohibited Uses
You may not: post fraudulent, misleading, or illegal listings; scrape or automated-collect data from the Platform; harass, threaten, or discriminate against other users; use the Platform for any illegal purpose; attempt to circumvent any security features of the Platform; impersonate any person or entity.
9. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TULUGAR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TULUGAR'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. TULUGAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Indemnification
You agree to indemnify and hold harmless TuLugar, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your content, or your violation of these Terms.
11. Termination
TuLugar may suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Platform ceases immediately.
12. Governing Law
These Terms are governed by the laws of the Republic of Paraguay. Any disputes arising from these Terms or your use of the Platform shall be resolved exclusively in the courts of Asunción, Paraguay.
13. Changes to Terms
TuLugar reserves the right to modify these Terms at any time. Changes will be posted on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms.
